FROM OBJECT TO SUBJECT: THE RISE OF WOMAN’S CONSENT TO MARRIAGE IN MEDIEVAL LAW


Summary


In Greek and Roman Law a marriage was a contract by which a father gave his daughter to her husband’s family for the purpose of creating heirs to property. A woman’s consent was not essential for a legally valid marriage in western and central Europe until the twelfth century. Woman’s consent to marriage became legally essential as a result of Christian teaching on the spiritual equality of the sexes, the church’s support of women’s right to choose celibacy, and church reformers’ elevation of consent over sexual union as the most essential element in marriage.
